1. Scope and contracting parties
These Terms apply to all contracts between the Provider and users regarding the use of the RevealMyStars platform, including the purchase of credits and the unlocking of digital content. Deviating terms of the user do not become part of the contract. The offering is directed at consumers within the meaning of the Austrian Consumer Protection Act (KSchG) and at businesses.
2. Description of services and nature of the content
RevealMyStars provides astrological content, in particular birth chart analyses, relationship analyses, yearly outlooks and a dialogue-based companion. The content is calculated automatically on the basis of the birth data provided by the user and prepared as texts with the support of artificial intelligence.
The user expressly acknowledges: astrology is not a science. All content on the platform serves exclusively entertainment, inspiration and personal self-reflection. It does not constitute statements of fact about future events, character traits or life circumstances and does not establish any guarantee of success, occurrence or accuracy of any kind.
The content is no substitute for professional advice. In particular, it does not constitute medical, psychological, psychotherapeutic, legal, tax or financial advice. The Provider expressly recommends making decisions in these areas of life solely on the basis of qualified professional advice. Decisions the user makes in reliance on astrological content are solely the user’s own responsibility.
The platform is intended for persons aged 18 and over.
3. Registration and account
Use of essential functions requires registration, either with an email address and password or via Sign in with Google. The user undertakes to provide truthful information and to keep access credentials confidential. An account is not transferable. The Provider is entitled to suspend or delete accounts in the event of violations of these Terms, misuse or unlawful conduct.
4. Credits, prices and payment
Certain content is unlocked using credits. Credits can be purchased via the platform at the prices displayed there. All prices are in euros and include any applicable VAT. Payment is processed by the payment service provider Stripe.
Purchased credits are non-transferable and will not be redeemed for money. Bonus credits granted free of charge upon registration have no monetary value and may lapse without replacement upon account deletion.
5. Right of withdrawal for consumers (Austrian FAGG)
Consumers generally have the right to withdraw from a distance contract within 14 days without giving reasons (Section 11 FAGG). For credit purchases, the period begins on the day the contract is concluded. Withdrawal may be declared without any formal requirements, for example by email to [email protected]. It is sufficient to send the withdrawal declaration within the period.
Expiry of the right of withdrawal for digital content: if the consumer expressly consents at the time of purchase to the provision of the digital service beginning before the withdrawal period expires, and confirms awareness that the right of withdrawal is thereby lost, the right of withdrawal expires upon commencement of provision in accordance with Section 18(1)(11) FAGG. This consent is obtained via a separate checkbox during the credit purchase. Credits already redeemed to unlock content are excluded from withdrawal.
If the consumer validly withdraws, the Provider shall refund all payments received without undue delay, at the latest within 14 days of receipt of the withdrawal declaration, using the same means of payment.
6. Availability
The Provider strives for high availability of the platform but does not owe uninterrupted availability. Maintenance, further development and disruptions at third-party providers (such as hosting, payment services or AI services) may lead to temporary restrictions. Announced and unannounced interruptions of reasonable duration do not give rise to any claims by the user.
7. Usage rights and user obligations
The user receives a simple, non-transferable right to use the content created for them for private, non-commercial purposes. Systematic reproduction, making publicly available or commercial exploitation of platform content is prohibited.
The user undertakes not to misuse the platform, in particular not to perform automated bulk queries, not to circumvent security mechanisms and not to enter unlawful content.
8. Warranty and liability
The statutory warranty rules apply to digital services purchased for consideration. For clarification: the warranty relates to the technical provision and functionality of the service. The entertainment and reflection character of astrological content is an agreed characteristic; the substantive accuracy, suitability for specific life decisions or the occurrence of interpretations is not owed and does not constitute a defect.
The Provider is liable without limitation for damage resulting from injury to life, body or health and for damage based on intent or gross negligence. Liability for other damage based on slight negligence is excluded. Vis-a-vis businesses, liability is additionally capped at the amount paid by the user to the Provider in the preceding 12 months; liability for lost profit and consequential damage is excluded vis-a-vis businesses.
Mandatory statutory liability provisions, in particular under the Product Liability Act and the KSchG, remain unaffected.
9. Changes to the service and to these Terms
The Provider may further develop the platform and change functions to the extent reasonable for the user, taking their interests into account. Changes to these Terms will be communicated to registered users in an appropriate manner. If the user does not object within 30 days or continues to use the platform, the amended Terms are deemed accepted; this will be pointed out separately in the notification. Material changes to the detriment of the user require their consent.
10. Termination and account deletion
The user may delete their account at any time in the settings without notice. Upon deletion, unredeemed credits granted free of charge lapse without replacement. For credits purchased for consideration and not yet redeemed, consumers will receive a pro-rata refund upon request, provided the purchase was made less than 6 months ago.
11. Applicable law and jurisdiction
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and the conflict-of-law rules of private international law. For consumers residing in the EU, the mandatory consumer protection provisions of their state of residence remain unaffected. For actions against consumers residing in Austria, the court of their place of residence has jurisdiction. Otherwise, the competent court at the Provider’s registered seat applies.
12. Final provisions
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected. The statutory provision applies in place of the invalid provision.
